Guardianship Evaluation
What is the purpose of a guardianship evaluation?
The attainment of guardianship is when a person or couple becomes legally responsible to provide and make decisions for another person, whether the person is a child or an adult. Sometimes guardianships are needed for adults that have been found to be impaired and where the individual’s decisions must be legally made by a guardian or power of attorney (POA).
Guardianship evaluations are sometimes legally required to protect the child or adult, and to assure the fitness and competence of the newly inherited guardian, or to establish that an adult is unfit to be their own guardian.
Guardianships may be needed for adoption. Florida law and other laws require that the guardians prove they are fit for the duties and responsibilities that are needed for the best interest of the child or adult.
These purpose of guardianship evaluations are to provide the legal system an expert evaluation on your appropriateness to stand as your own guardian or take over the responsibilities of a person’s legal guardian, and to prove that the child’s or adult’s best interest is fulfilled.
Are you looking for a firm or expert in which can assist you to complete the guardianship evaluations needed to establish and certify your guardianship of a child or an adult with mental health or physical disability? What do guardianship evaluations measure?
There are two major types of guardianship evaluations:
- There are guardianship evaluations that can determine if a person is fit or unfit to be their own guardian.
These types of evaluations measure and consider:
- Mental and physical fitness and health.
- Any disabilities that can harm the person’s ability to make safe and legal decisions for themselves.
- A diagnostic evaluation for any mental or neurocognitive disorders or deficits.
- There are evaluations that are conducted to prove that an adult or couple is found to be fit to take on a guardianship of a child or an adult.
These types of evaluations assess and consider:
- The legal competence that the adult or couple has.
- Fitness for duty of a guardian and caregiver.
- The understanding the adult or couple has of their duties.
- The health and eligibility of the adult or couple.
